Website Terms of Use

These Website Terms of Use apply to use of the Forensys Veridica website, consultation bookings and services, unless a separate written agreement applies.

Please read these terms together with the Professional Disclaimer and Privacy Policy.

[LEGAL REVIEW REQUIRED]

Acceptance of these terms

By using this website, making an enquiry, booking a consultation or engaging Forensys Veridica, you agree to these Website Terms of Use to the extent permitted by law.

If separate written engagement terms are issued for substantive services, those written terms will apply to the relevant engagement. If there is an inconsistency, the written engagement terms will prevail to the extent of the inconsistency.

Scope of services

Forensys Veridica provides factual evidence organisation and litigation support. Services may include chronologies, evidence organisation, document indexing, evidence matrices, contradiction analysis, factual drafting support, exhibit preparation support and related administrative or analytical support.

The scope of any substantive service must be confirmed in writing before work begins.

No legal advice or legal representation

Forensys Veridica is not a law firm and does not provide legal advice, legal opinions, legal strategy, legal representation or advocacy.

Using this website, booking a consultation or engaging Forensys Veridica does not create a solicitor-client relationship.

You should consult a qualified Australian legal practitioner if you need advice about your legal rights, obligations, claims, defences, prospects, deadlines, evidence rules, court or tribunal procedure, filing requirements or legal strategy.

Client responsibilities

You are responsible for:

  • providing complete, accurate and truthful information;
  • identifying any known deadlines;
  • telling Forensys Veridica if any material is confidential, sensitive, privileged or subject to restrictions;
  • obtaining legal advice where legal advice is required;
  • deciding whether and how to use any materials prepared by Forensys Veridica;
  • checking court, tribunal, agency or procedural requirements;
  • complying with any orders, directions, deadlines, filing rules, service rules or legal obligations;
  • ensuring you have the right to provide any material sent to Forensys Veridica; and
  • reviewing deliverables promptly and raising any concerns within the agreed review period.

Forensys Veridica relies on the information and material you provide. Incomplete or inaccurate information may affect the usefulness of any deliverable.

Booking and payment

Initial consultations are 60 minutes and cost AUD 220. Payment is required at the time of booking.

Consultation bookings are handled through Calendly. Calendly invokes Stripe for payment as part of the booking process.

Do not send payment card details to Forensys Veridica by email.

Consultation credit

AUD 110 may be credited to the first approved substantive service where appropriate and confirmed in writing. The credit is not automatic.

The credit applies only if Forensys Veridica agrees to provide further substantive services and confirms the credit in the written quote or engagement terms.

Cancellations, rescheduling and refunds

Clients may cancel or reschedule without charge up to 24 hours before the scheduled consultation.

Requests made less than 24 hours before the scheduled consultation may be subject to the business cancellation policy.

This cancellation wording is an owner-updatable business policy. Any update MUST be version-controlled and applied consistently to this page, the Book page, Terms of Engagement, Calendly settings and booking confirmations. Refund terms remain [OWNER TO CONFIRM] [LEGAL REVIEW REQUIRED].

LEGAL REVIEW REQUIRED

Quotes and substantive services

The initial consultation is booked through Calendly. Any substantive forensic consulting, evidence analysis, chronology preparation, document review, report preparation or ongoing engagement requires an individual written quotation.

No substantive service begins until the business accepts the engagement and the client accepts the written scope, deliverables, assumptions, exclusions, timing, fees, payment terms and applicable Terms of Engagement. Booking a consultation alone does not create an ongoing engagement.

Forensys Veridica may decline work if the matter is outside scope, unsuitable, creates a conflict or risk, requires legal advice, involves inappropriate conduct, or cannot be completed within the required timeframe.

Third-party services

This website may use third-party services, including Calendly for scheduling and Stripe for payment.

Third-party services are operated by their respective providers and may be subject to separate terms, privacy policies, security practices, processing locations, fees and availability.

Forensys Veridica is not responsible for third-party outages, errors, declined payments, account issues or service changes except to the extent required by law.

Evidence transfer

The public website does not accept evidence uploads. Evidence transfer, where required, must be arranged separately.

Ordinary email should not be used as the default method for sending sensitive evidence, large evidence bundles or confidential material. Forensys Veridica will confirm an appropriate transfer method where required.

Intellectual property

Unless otherwise agreed in writing:

  • you retain ownership of the source material you provide;
  • Forensys Veridica retains ownership of its pre-existing methods, structures, templates, know-how, formats and internal working materials;
  • paid deliverables prepared for you may be used by you for the matter for which they were prepared; and
  • you must not resell, publish, copy or adapt Forensys Veridica templates, methods or materials for unrelated purposes without written permission.

Specific intellectual property and licence wording is: [LEGAL REVIEW REQUIRED].

Confidentiality and privacy

Forensys Veridica will handle client information in accordance with its Privacy Policy, any applicable written engagement terms and applicable law.

Confidentiality does not create a solicitor-client relationship or legal professional privilege.

Acceptable use of the website

You must not use the website to:

  • send unlawful, misleading, abusive, defamatory or harmful material;
  • attempt to gain unauthorised access to systems or accounts;
  • interfere with website security or operation;
  • scrape, copy or reproduce website content for commercial use without permission;
  • impersonate another person;
  • send malicious code or spam; or
  • misuse contact channels or booking systems.

Forensys Veridica may restrict, refuse or cancel access, enquiries or bookings where misuse is suspected.

Disclaimers and liability

Forensys Veridica does not guarantee any legal, tribunal, workplace, employment, insurance, administrative, commercial or personal outcome.

To the extent permitted by law, liability wording, exclusions, caps, consumer-law carve-outs and consequential-loss terms are: [OWNER TO CONFIRM] [LEGAL REVIEW REQUIRED].

Nothing in these terms is intended to exclude, restrict or modify rights that cannot lawfully be excluded, restricted or modified.

Governing law

Governing law and jurisdiction wording is: [OWNER TO CONFIRM] [LEGAL REVIEW REQUIRED].

The launch assumption is Western Australia, subject to legal review and confirmation.

Changes to these terms

Forensys Veridica may update these Website Terms of Use from time to time. The published version on the website is the current version.

Changes will not retrospectively alter a signed written engagement unless the engagement terms allow that change or the parties agree in writing.
